Doctor faces 13 counts

GLASGOW — Monroe County doctor Clella Hayes was indicted Wednesday by a federal grand jury in Bowling Green with prescribing pain medications outside the course of professional medical practice, which resulted in the death of a patient, according to the U.S. Attorney’s office for the Western District of Kentucky.

Law enforcement conducted a search and seizure of files and records at Hayes’ office on North Main Street in Tompkinsville in March.

Tompkinsville Police Chief Dale Ford said at the time that an investigation had been ongoing for more than two years into Hayes’ practice.

Hayes, 39, of Glasgow, allegedly distributed fentanyl to a patient on or about Sept. 19, 2011, that resulted in the patient’s death, according to federal prosecutors. Also, between June 2009 and September 2011, she allegedly illegally dispensed to the same patient morphine, Oxycodone, Demerol and hydrocodone, according to a press release from the U.S. attorney’s office.

Hayes was indicted Wednesday on 13 counts of dispensing and distributing schedule II and schedule III controlled substances outside the course of her professional medical practice. She was charged with issuing between June 2010 and March prescriptions to eight patients for fentanyl, morphine, Oxycodone, Demerol, hydrocodone, Cheratussin and valium.

If convicted, Hayes could spend up to life in prison, face a fine up to $2.5 million and three years of supervised release, according to the press release.

The case is being prosecuted by assistant U.S. Attorney David Weiser. It has been investigated by  Kentucky State Police Drug Enforcement/Special Investigations West and the Federal Bureau of Investigation, with assistance from Tompkinsville police.

An indictment by a grand jury is an accusation only and that person is presumed innocent until proven otherwise.
