Fiscal court splits vote on publication of records

GLASGOW — The Barren County Fiscal Court did not pass a motion Tuesday night to publish all Barren County Detention Center records of private investigator Michael J. Ober on the Barren County government’s website, after the court was split on a 4-4 vote.

Magistrate Chris Steward proposed the motion to publish Mike Ober’s records at the end of Tuesday’s regular meeting. Steward had requested to be put on the agenda “to address issues relating to jail and jailer.” Before he started, Judge-Executive Davie Greer asked Steward whether the fiscal court could do anything about what he wanted to discuss, and when he said yes, she told him he had four minutes to make his point.

Steward began by explaining that he has always been against the release of the Ober records, both because the FBI asked the court to prevent the release and because he feared those who were interviewed by Ober might be harassed or hurt if their interviews were made public. Now that the county lost the open records battle against the Glasgow Daily Times in court, Steward said the records, including audio recordings, documents and typed interview notes, should be published on the county government’s website for all to see.

“The horse is out of the barn now,” Steward said after the meeting.

Copies of Ober’s records have been distributed to media outlets and individuals who made open records requests for the material, as well as the members of the fiscal court.
