The case of a terminated fire department sergeant is in the process of returning to Barren Circuit Court on appeal.
The appeal had been filed last year after the council decided June 18, 2012, that Glasgow Fire Department Sgt. Roger Hampton was guilty of four of the six charges against him. It had been set for a bench trial on Jan. 3, but the involved parties requested a continuance, according to court records.
In July, a motion was filed asking for a dismissal of charges with the argument that the count against him for which he was fired and another count for which he was suspended were the same charge for the same violation, with only slightly different wording regarding a blood test’s revealing medication that he had not reported to his supervisor. Barren Circuit Judge Phil Patton agreed with that argument in late August and remanded only that issue to the council for its consideration.
