Judge denies shock probation for teen

GLASGOW — Joseph Arbogast, 18, one of two co-defendants in a 2011 armed robbery case, has been denied a request to be released after serving the first few months of a 10-year sentence.

The case was on the docket Monday in Barren Circuit Court, but Judge Phillip Patton had already filed his order a few days earlier denying the shock probation, so there was no need for the defendant or attorneys to appear in court. The shock probation program allows first-time offenders to be released from custody after serving a brief time. Patton agreed with the prosecution that granting defense attorney Alan Simpson’s motion for the probation at this point would depreciate the seriousness of the crime, according to court documents.
