State seeks death penalty for Walden

TOMPKINSVILLE

A Tompkinsville man charged in connection with the murder of two Monroe county men will face the death penalty.

Jesse M. Stockton Jr., commonwealth’s attorney for the 40th Judicial Circuit, has filed an intent to seek the death penalty against Paul H. Walden, 39, Tompkinsville.

Walden is accused of shooting Jackie Eubank, 47, and Nicholas Butler, 29, both of Tompkinsville, sometime between July 19-20 at Eubank’s home on Sulphur Lick Road near Tompkinsville.

Under Kentucky law, there are certain criteria that allow prosecutors to seek the death penalty. One of those is multiple homicide.

The specific allegations against Walden for the intentional murder of Eubank and Butler is also part of the criteria, according to Monroe County Circuit Court records.

Walden entered a not guilty plea to two counts of murder on Sept. 17 during a pretrial hearing.

Walden was arrested July 20 and charged in connection with the murders and lodged in the Monroe County Jail. He was arraigned on July 22 on two counts of first-degree murder.

During a preliminary hearing July 29, probable cause was found and his case waived to the grand jury.
