A Cave City councilman and his wife are suing several members of the Cave City Volunteer Fire Department.
The civil suit was filed in Barren Circuit Court by Todd Esters and his wife, Zoeda Deskins, on July 8.
In the suit, the couple allege that Capt. Michael Bale, Capt. Roger Scott, Lt. Terrill Riley, along with firefighters Tommy Crain, Jason Logsdon, Jorelle Minor, Dustin Neal and Bruce Neville committed “deliberate acts of tortuous conduct” at the couple’s home on Whitney Woods Drive on Oct. 3, 2007, and Nov. 17, 2007.
According to the lawsuit, Scott borrowed a paintball gun from Cave City Police Capt. Danny Coomer per Neville and drove in a city-owned
vehicle, along with Bale, Logsdon, Neal and Neville, to the home. Upon arrival, Bale is accused of shooting toward Esters’ and Deskins’ vehicles, striking a 1999 Cadillac Escalade on the driver-side door causing $304 in damage.
The suit also alleges that on Nov. 17, 2007, Riley, Wilson, Minor and Crain were playing cards at Riley’s house when they decided to egg Esters’ cars.
According to the lawsuit: “They all agreed ... They then left in Terrill Riley’s 2004 GMC Truck with Brian Wilson driving and picked up Tommy Crain. They parked at the old Junior Foods on the corner of U.S. 31W and Ky. 90 in Cave City. Riley, Wilson, Crain and Minor walked to Esters’ house. Riley, Crain and Minor egged Esters’ 2001 Ford Mustang and his 1991 Cadillac Escalade. Wilson was putting toilet paper in a bush in Esters’ yard. The four men then ran back to the truck.”
Two of the men – Minor and Riley – are accused of returning later and cutting two tires on the driver side of Esters’ Mustang.
Esters and Deskins want a jury trial and are seeking punitive damages, attorney fees and all other just and proper relief to which they are entitled.
Scott, Neal and Coomer were present at Monday’s meeting of the Cave City Council. All three declined to comment on the case. The other defendants either did not return phone calls or were not able to be contacted.
Esters did not attend the council meeting. Phone calls to his house Tuesday were not returned.
