Malfeasance means intentionally doing something either legally or morally wrong, which one had no right to do. Misfeasance is defined as through the management of a business, public office or other responsibility in which there are errors and an unfortunate result through mistake or carelessness, but without evil intent and/or violation of law. The formal Kentucky statue states that jailers along with other government officials may be indicted in the county in which they reside for misfeasance or malfeasance in office, or willful neglect in the discharge of official duties, and if convicted they shall be fined not less than $100 nor more than $1,000, and the judgment of conviction shall declare the office held by such person vacant.
