11:06 MORNING UPDATE: Judge affirms AG's open records ruling

GLASGOW — The Barren County Fiscal Court will be required to provide an investigative report on the Barren County Detention Center to the Glasgow Daily Times within five days after the close of the appeal period, according to a ruling released Thursday morning.

Barren Circuit Court Judge Phil Patton affirmed the attorney general's earlier opinion that the fiscal court violated open records law when it denied the Daily Times access to investigative documents compiled by private investigator Michael J. Ober and paid for with tax dollars.

The fiscal court will be given the documents, which have thus far only been seen by the judge, and will have the opportunity to redact any information that is allowed exemption under Kentucky Revised Statute. Documents to be released include transcripts of interviews, interview notes and all other records produced by Ober, the ruling stated, and the fiscal court is required to set forth legal explanations for any redaction. Any audio tape transcription costs will be incurred by the fiscal court.
